E Visas for Investors

Visas for foreign investors are known as E visas, and they fall into one of the following categories:

  • E-1 Visas - Available for treaty traders who are citizens of countries with which the United States has a treaty of commerce and who carry on trade between the U.S. and their home country.
  • E-2 Visas - Available for treaty investors who are citizens of countries with which the United States has a treaty of commerce and who have invested a substantial amount of capital in a business in the U.S.
  • EB-5 Visas - Available for investors in a new commercial enterprise in the United States. To qualify for this type of visa, an enterprise must create full- time jobs for at least 10 employees who are authorized to work in the U.S., and it must include a capital investment of at least $1 million, or $500,000 in a high unemployment or rural area.

Investors can apply for an E-1 or E-2 visa by filing Form I-129 (Petition for Nonimmigrant Worker). An investor can apply for an EB-5 visa by filing Form I-526 (Immigrant Petition by Alien Entrepreneur). Following approval of an EB-5 visa, a person may apply to receive lawful permanent resident status by filing Form I-485 (Application to Register Permanent Residence or Adjust Status).

Business Plans for Potential Immigrant Investors

To receive an investor visa, applicants must submit a comprehensive business plan which demonstrates that they meet the requirements to receive a visa and shows that their business will be viable. A business plan should include:

  • A description of the nature and goals of the business, including its products and/or services.
  • A market analysis, including a comparison with competitors and a description of prospective customers.
  • Required permits and licenses which have been obtained.
  • A description of the manufacturing or production process and the sources of materials and supplies, if applicable.
  • Contracts for obtaining materials or distributing products.
  • Planned marketing strategies.
  • The business's organizational structure.
  • Staffing requirements and job descriptions for all positions to be filled.
  • Projection of sales, expenses, and income.
